Timothy Batts who SHOT his daughter to death tests positive for COCAINE. Bail may be revoked


Timothy Batts, the Hendersonville man charged in the shooting death of his 11-year-old daughter, Timea, has failed a drug test, according to Sumner County District Attorney Ray Whitley.

Whitley said he was notified of the failed drug screen Friday and has filed a motion to revoke Batts' bond.

According to the state's motion on file at the Sumner County Courthouse, Batts tested positive for cocaine on Monday.

During an Aug. 12 bond hearing, investigators with the Hendersonville Police Department gave testimony that suggested Batts told at least two different versions of what led to Timea's death. He initially told police Timea arrived from Knox Doss Middle School on Aug. 8, entered the home and yelled she had been shot.

Batts later told police he had been sleeping and thought Timea was an intruder, according to his arrest affidavit. However, video surveillance collected from the home showed Batts had been awake and was talking on the phone with a gun in his hand a few minutes before his daughter arrived home from her first day of sixth grade.

Timea's funeral was held Tuesday at Mt. Zion Baptist Church in Nashville.

Batts, 29, was released from the Sumner County Jail the night of Aug. 12. Earlier that day, Judge James Hunter lowered his bond from $1 million to $500,000. Batts has been charged with reckless homicide, tampering with evidence, false reporting and possessing a firearm as a felon.

Hunter said if Batts made bail, he would be required to report to an officer once a week and pass random and regular drug and alcohol tests. Additionally, he was not to be in possession of a firearm or pick up new criminal charges.

Batts is scheduled to appear in Hunter's courtroom for a bond revocation hearing Aug. 26.
